Terms, Conditions and Acceptable Use Policy

Stonix.com Inc. provides web services such as website design and development, custom programming, web hosting, and website promotion. Stonix.com Inc. has certain legal and ethical responsibilities consistent with the use of its server and equipment involved in these services.

The general policy of Stonix.com Inc. is to act as a service provider of Internet presence. Stonix.com Inc. has specific ethical concerns regarding the use of the service detailed below. Stonix.com Inc. reserves the right to suspend or cancel, under our discretion, a customer's access to any or all services provided by Stonix.com Inc. when we decide that the account has been inappropriately used.

Specific Acceptable Use Policies

Server abuse
Any attempt to undermine or cause harm to a server, or customer, of Stonix.com Inc. is strictly prohibited.

Terms of Unlimited Traffic
Stonix.com Inc.'s customers are privileged to be offered unlimited traffic. Unlimited traffic applies to standard web documents (JPEG, GIF and HTML). All other types of files such as (ZIP, MP3, etc.) are subject to 3 GIG of transfer per month. Sites containing paid advertisements, such as banner ads are allowed 6 GIG of transfer per month. Any customer who exceeds this limit will be notified by Stonix.com Inc. to resolve the situation. Extra bandwidth is $30 per GIG. Illegal MP3 files, illegal RealAudio files, illegal/ copyrighted clipart or any illegal content on your site/account is prohibited. You (the customer) take full responsibility for the data residing under your account.

To maintain the integrity of our service the following limitations apply, Stonix will be the sole arbiter as to what constitutes a violation of this provision.

Commercial Advertisements with E-mail
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and E-mail. If you are found to have spammed, we will contact you to resolve the situation. If it is a severe case then we will immediately, without warning, disable your domain until the situation is resolved. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without refund.

Chat Rooms
We do not allow clients to install their own chat rooms without approving it with the Stonix Support Team.

Background Running Programs
We may allow programs to run continually in the background. These are considered on a one-to-one basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

CGI Scripts
If your account has a CGI script(s) that continuously uses more than 15% of the server's system resources, you will be asked to remove it within 24 hours. If no action is taken we will disable it. If the script(s) is severely affecting the server, we do reserve the right to disable it immediately.

Payment Policies

Domain registration and web hosting
All accounts are set up on a pre-pay basis. Domain Registration fees are non-refundable. Setup fees for web hosting may be charged for new accounts and major account changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Stonix.com Inc. in writing for a request for termination of services.

Website design
Customers agree to pay 50% of the design and development fee as a deposit for the project. Final payment must be made when you receive your final invoice. Please ensure that we receive your payment on or before the due date. A late fee of 17% of the due amount applies for accounts that are past due between 15 to 30 days. Accounts which are past due over 25 days incur an additional $20-$50 re-activation fee.

Currency & Tax
All payment is in Canadian currency. 5% GST applies. No GST for customers outside Canada.

Cancellation
Cancellation of a signed contract before the start of a project will incur a 25% administration fee. Stonix.com Inc. reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Stonix.com Inc., if Stonix.com Inc. institutes its right of cancellation. Any violation of policies which results in extra costs will be billed to the customer.

Copyright

For those websites which are developed and or customized by Stonix.com Inc., the backend codes (files suffixed with .php, .jsp, .cgi, .pl, and any programs or scripts executable on server side) are properties of Stonix.com Inc. Customers are granted rights to use these files. Disclosing these files to a third-party vendor via client is strictly prohibited. Modifying and re-development based on these files by third-party vendor via client is strictly prohibited. Failure to comply with these policies will cause termination of service from Stonix.com Inc. and will lead to serious consequences.

Lawful Purpose

Stonix.com Inc. reserves the right to refuse service to anyone. Pornography, nude images or nude pictures or any form of adult nudity or child nudity (pedophiliac material) is strictly prohibited (not allowed). Also, any attempts to hack into the server will lead to serious consequence. We have the right to cancel the offender's account without prior notice and perform a full investigation. In severe cases, the proper authorities will be informed and involved.

Privacy

Stonix.com Inc. values clients' privacy and we ensure the confidentiality of personally identifiable information. We will not disclose your personal information unless you give us permission, or unless required by law. Please be absolutely assured that all your information will remain completely confidential. None of the information will be shared with sources outside of Stonix.com Inc.

Disclaimer

Stonix.com Inc. will not be responsible for any damages your business may suffer. Stonix.com Inc. makes no warranties of any kind, expressed or implied for services we provide. Stonix.com Inc. disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Stonix.com Inc. and its employees. If you are dissatisfied with Stonix.com Inc. service or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service.

Stonix.com Inc. will not be responsible for the customer.s website content (including text and images provided by the customers). It is the customer.s sole responsibility to provide website content, especially text content, and to make sure the website content is free from controversy and lawful dispute.

Stonix.com Inc. com reserves the right to revise its policies at any time. Failure to follow any term or condition will be grounds for immediate account deactivation. We are not responsible for misuse of the information on the website.
